Terms of Use
The agreement between you and BRAKR. It is written to be read, because the parts that matter most are the ones about what this app cannot do for you.
The agreement
These Terms of Use are a contract between you and the operator of BRAKR (“BRAKR”, “we”, “us”). By downloading or using the BRAKR app you accept them. If you do not accept them, do not use the app.
Our Privacy Policy is part of this agreement and explains what we do with your data.
What BRAKR is not
BRAKR is not medical care, therapy, counselling, or a treatment programme. It is a self-help tool. It cannot diagnose a gambling disorder, and using it is not a substitute for professional help. If you are in crisis or considering harming yourself, contact your local emergency number or a gambling helpline immediately.
We make no promise that using BRAKR will stop you gambling or keep you from relapsing. Recovery is yours; the app is a set of tools that can help you do it.
Eligibility and your account
You must be at least 18 years old to use BRAKR. You are responsible for keeping your sign-in details secure and for everything done through your account.
You may delete your account at any time from Settings → Delete Account. Deletion is permanent and we cannot recover the record afterwards.
Subscriptions and billing
BRAKR offers auto-renewing subscriptions. Where a free trial is offered, its length is shown on the purchase screen before you buy.
- Payment is charged to your Apple Account when you confirm the purchase.
- The subscription renews automatically unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours of the end of that period.
- You can manage and cancel your subscription in your Apple subscription settings. Deleting the app or your BRAKR account does not cancel it.
- If a free trial is offered, any unused part of it is forfeited when you buy a subscription.
- Purchases are processed by Apple. Refunds are handled by Apple under its own terms; we cannot issue them. Request one at reportaproblem.apple.com.
- We may change prices. A change never affects a period you have already paid for, and you will be told before a renewal at a new price.
Apple’s standard Licensed Application End User License Agreement also applies to your use of the app. Where it conflicts with these terms, these terms govern to the extent permitted.
How blocking works, and its limits
BRAKR blocks apps and websites using Apple’s Screen Time framework. You grant that permission, you choose what to block, and you can remove the permission at any time in iOS Settings.
Blocking is a barrier, not a cage. It can be undone by you, and it can be circumvented — by another device, a browser we do not cover, a new app or domain not yet in our list, or by turning the protection off. We work to keep the blocklist current and you can report anything we have missed from inside the app, but we do not warrant that any specific app or site will be blocked, or that blocking will not occasionally catch something it should not.
Community rules
Community is a space for people trying to stop gambling. Anything you post there is visible to other people using BRAKR, and you keep ownership of what you write while granting us the licence needed to display and moderate it.
You must not post:
- Anything that promotes gambling — including tips, odds, results, referral links, bonus codes, or the names of bookmakers presented as recommendations.
- Harassment, hate, threats, or content targeting a person.
- Other people’s private information, including your own full name if you would rather stay anonymous.
- Advertising, spam, or solicitation, including offers to lend or recover money.
You can report a post or a person, and you can block someone so their content no longer reaches you. We may remove content, and suspend or ban accounts, at our discretion, with priority given to keeping the space safe for people in early recovery.
Acceptable use
Do not reverse engineer, decompile, or interfere with the app or our servers; do not try to access another person’s account or data; do not use automated means to scrape the service; and do not use BRAKR to break the law.
Ownership
BRAKR, its name, design, and software are ours and are licensed to you, not sold. You keep everything you write. By posting in Community you grant us a non-exclusive, worldwide, royalty-free licence to host, display, and moderate that content within the service — a licence that ends when the content is deleted, except for copies retained for moderation or legal obligations.
Ending the agreement
You may stop using BRAKR at any time by deleting your account. We may suspend or end your access if you breach these terms, or if we stop offering the service — in which case we will give reasonable notice where we can, and you can cancel your subscription through Apple.
Disclaimers and liability
The app is provided “as is”. To the fullest extent permitted by law we disclaim all implied warranties, including fitness for a particular purpose, and we do not warrant that the app will be uninterrupted, error-free, or that blocking will be complete.
To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential losses, and our total liability to you is limited to the amount you paid us in the twelve months before the claim. Nothing here limits liability that cannot be limited by law — including liability for death or personal injury caused by negligence, or for fraud. If you are a consumer, you keep the statutory rights your local law gives you, and nothing in these terms takes them away.
General terms
We may update these terms. If a change materially affects you we will tell you in the app before it takes effect, and the effective date at the top will change. Continuing to use BRAKR after that means you accept the new terms.
If any provision is held unenforceable, the rest stays in force. Questions about these terms go to support@getbrakr.app.
